摘要:近年来,我国教育体系中家庭教育、学校教育和社会教育三大支柱已逐渐呈现不平衡的状态,家庭教育被弱化,这其中最主要的原因之一是立法的缺失,缺乏关于家庭教育的专门立法。同时现有零散的法律规定未明确家庭教育权利、义务以及相关法律责任。因此,亟需制定专门的《家庭教育法》,保障家庭教育的法律地位、明确家庭教育权利义务及相关法律责任,并以《家庭教育法》为核心,立足我国国情和文化传统,构建完善的具有中国特色的家庭教育法律系统。In recent years,the three pillars of China’s education system-family education,school education and social education have gradually become unbalanced,in which family education has been weakened. One of the principal reasons is the lack of legislation on it, particularly the lack of specific legislation on family education,and the unclarity in the rights,obligations and related legal responsibilities of family education in the existing scattered legal provisions. Therefore,it is urgent to enact the Family Education Law to protect the legal status of family education, to clarify the rights and obligations of family education and legal responsibilities involved. In addition, with the Family Education Law as the core, based on China’s national conditions and cultural traditions, a sound family education legal system with Chinese characteristics can be built.
